FEDOTOV&PARTNERS attorneys have successfully defended the interests of a client, an electricity exporter.

Case background: Since 2021, NPC Ukrenergo had been applying a transmission service tariff to the volume of electricity exported from the Ukrainian power grid.

The exporting company, considering these actions by the transmission system operator to be unlawful, refused to pay the corresponding invoices.  

NPC Ukrenergo filed a lawsuit against the client to recover an alleged debt of 5,958,203.84 UAH.  

The Commercial Court of Kyiv (Case No. 910/1393/22) fully dismissed NPC Ukrenergo's claims, ruling them to be groundless.

FEDOTOV&PARTNERS attorneys successfully argued that the electricity transmission service was not covered by the terms of the transmission service agreement concluded between the parties, and that the charges were in violation of the Law of Ukraine "On the Electricity Market," European energy legislation, and European Court practice.
